Terms and Conditions
In these Terms and Conditions, the words “us,” “we,” and “our” refer to 5 Circles Business Development LTD., the owner of the following websites, products, and services:

- Products: Our "Swap Hunter" Software for MetaTrader 4
- Services: The services we offer when you contact Swap Hunter Support
By accessing or using our websites, products, or services, you agree to be bound by these Terms and Conditions, including our Privacy Policy (https://www.swap-hunter.com/privacy-policy/).
These Terms and Conditions affect your legal rights and obligations. If you do not agree to be bound by all of these Terms and Conditions, do not access or use our websites, products, or services.
Users of our websites, products, and services must be above the age of 18.
1. License
As a license holder of our products, you cannot distribute, freely give away, or resell your license. You may not transfer the license to a new owner.
You must use your license on Accounts that you own or manage. You may use your license on a client account in situations in which you maintain an ongoing relationship with your client as a consultant. By using your license on a client account, you acknowledge and agree that your client will come to you for support.
Any third-party libraries in our products are subject to their own licensing. You are responsible for reviewing and following third-party licenses, terms, and conditions.
2. Payments and Price Changes
When you purchase a product, you are actually purchasing a membership subscription with 5 Circles Business Development LTD, which gives you access to the Product, product updates and support for a period of one month, or year following the date of purchase. Exception is the Lifetime "Expert" Licence, which grants you lifetime support for the purchased Version, but not Function Updates
All products that you purchase are added to a single membership with a single license. Each product subscription included in your membership is due for renewal every Month, or Year from the date of purchase.
Products purchased on May 1, 2017 or later renew automatically unless you turn off that option on your My Accounts page.
5 Circles Business Development LTD reserves the right to modify or discontinue, temporarily or permanently, prices of all products or subscriptions, including monthly or annual subscription fees, at any time with or without notice. Such notice may be provided at any time by posting the changes to the 5 Circles Business Development LTD Terms and Conditions. All prices are in € Euro.
3. Refund Policy
Although we don’t think you’ll ever want a refund, we gladly refund your purchase if it’s requested within 14 days. No Refunds will be given for Trial Licences. No refunds will be given after 14 days from the initial purchase under any circumstances.
4. Product Updates and Support
Product updates are released as often as needed for bug fixes, compatibility, or feature additions.
Online support is offered through a ticketing system. We do not offer phone support, nor do we offer support or otherwise for the installation, customization or administration of Meta Trader 4 itself or third-party applications.
If your membership has expired, in order to get an update or submit a support ticket you must renew your monthly/annual membership subscription, regardless of the situation or circumstance. A lapsed subscription that is renewed starts from the date you purchase it, but there are no discounts that may be applied to the renewal cost.
5. Newsletter and Email
By purchasing Swap Hunter, you agree to be signed up for our newsletter, which will be sent to you occasionally to announce new releases, updates, and other news. You are free to opt out at any time by clicking on the link provided in the newsletter. We do not give your personal information to any third-party companies, as mentioned in our Privacy Policy.
5 Circles Business Development LTD may on occasion send you email notifications related to your licenses. These transactional emails may include notification of licensing changes, changes to our terms and conditions, license expiration notices and other transactional emails related to your purchases. You cannot unsubscribe from these account notices.
6. Ownership
All of our products, with the exception of any third-party components contained in the products, are the property of 5 Circles Business Development LTD. You may not claim intellectual or exclusive ownership to any of our products, modified or unmodified.
7. Termination and Cancellations
5 Circles Business Development LTD, in its sole discretion, has the right to suspend or terminate your account for violation of the Terms and Conditions and refuse any and all current or future use of the service or products provided by us. Termination will result in the deactivation or deletion of your account and access to your account, including the deactivation or deletion of all content in your account.
5 Circles Business Development LTD reserves the right to refuse services or products to anyone for any reason at any time, refund your payment, and terminate your account if deemed necessary.
If you are dissatisfied with any aspect of our services or products and wish to terminate your account voluntarily, you may do so by contacting us, but no refund will be provided beyond 14 days after purchase. When you voluntarily terminate your account, we will deactivate and delete it and all content contained in it.
8. Warranty and Liability
We guarantee our products to function as advertised when installed on a clean Meta Trader 4 and when activated without any changes. We cannot guarantee our products will function with all third-party components, plugins or applications
Beyond this guarantee, we provide our products “as is” without warranty of any kind, expressed or implied. We shall not be liable for any damages, including but not limited to direct, indirect, special, incidental or consequential damages or losses that occur out of the use or inability to use our products.
5 Circles Business Development LTD's aggregate liability under or in connection with the Terms and Conditions will be limited to the amount paid for the services or products if any. This limitation will apply even in the event of a fundamental or material breach of this Terms and Conditions.
9. Indemnity
You agree to indemnify and hold 5 Circles Business Development LTD, officers, directors, employees and agents, harmless from any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from trades, speculations, or through any other use of our services or products, your connection to our service or products, your violation of the Terms and Conditions, or your violation of any rights of another.
